Downey is being charged with simple assault, which sounds like what can happen if you tell somebody you'e going to kick their ###. So now, 10 days later, the charge is still simple assault?? No battery? In other words, there has been no ### kicking?

Sounds like the guys had words and now the other kid is acting like a ##### just to get an athlete in trouble.

Details are limited according to that news report but I imagine it was serious enough for him to be arrested after the initial investigation even though the spokesman said it was a minor incident. Not sure why it took the student 10 days to file charges or why he (or she) changed his/her mind after not pressing charges right away. Perhaps he/she was still distressed and reluctant to press charges and when he/she got his/her head straight he/she talked to someone of authority who convinced what happened to him/her was no minor act to be ignored. I'm willing to bet the victim was a girl. Then I can understand the fear and the wait. If it was me, I would have laughed it off unless he had a weapon. He/she could be a ##### like you said. If your right, why wait a week to get the athlete in trouble?

The point is that it appears it's been at least 10 days since the "assault" yet there has been no battery. Obviously Downey has not been too eager to actually do anything to the person.

Of course that could have been something as simple as poking his finger in someones chest. Having said that, I do disagree with your assessment that the sex of the complaintant is irrelevant.

I'm not trying to say it's not worse if he threatened a female.

I'm simply (no pun intended) saying that for there to be an "assault" there has to: 1. be a threat made and 2. the receiving person has to believe the threat is real.

10 days after the incident, and after the complaitant originally decided not to press charges, makes it seem like the person didn't believe the threats to be real.

I guess we'll see how it turns out.

Columbia (WLTX) -- University of South Carolina police arrested USC men's basketball star Devan Downey Monday night on charges of simple assault.

Downey is being held at the Richland County jail on charges for simple assault.

Typically, one is charged with simple assault when they make a verbal threat to another.

Russ McKinney with the university says the incident happened last week. McKinney told News19 that Downey and another student were involved in a minor altercation. The spokesman says the student just decided to file charges Monday.

There is no word on whether Downey has been suspended from the team. USC policy states that any player who is arrested for any charge is automatically suspended from the team.

Downey, a Guard from Chester, is a sophomore on the team and transferred from Cincinnati.

south carolina players get arrested. I can't believe that the NCAA hasn't placed them on any sanctions. It is like 2 gamecock players get arrested on average every 3 weeks.
