Hear me out on this: Jihadi Janes

Feb 21, 2019, 9:01 AM

So looks like this is dominating the news recently with these idiots leaving the country (one US one Britain) and going to join ISIS. Now that ISIS is almost defeated, they want to come back.

The discussion is, the country is renouncing their citizenship.

Now I know the more reactionary posters on this board will say good. #### them. But I say nay nay.

Do we really want our government to be able to revoke citizenship at will? Even when it deems necessary? What would stop the party in power for trying to revoke citizenship from the minority party at some point in time?

To echo some posters on this board "that's a slippery slope."

I say bring them back as American citizens. Try them for treason, aiding the enemy whatever. Then execute them.

Thoughts?

The girl in question was born while her dad (a diplomat)

Feb 21, 2019, 9:03 AM

was visiting the US. Not really a US citizen......

How she got a passport is still a mystery that will be investigated.

flag link military_tech thumb_downthumb_up

Was she born on US soil? and Isn't her mother a US citizen?

Feb 21, 2019, 9:04 AM

Pretty sure that makes her a US citizen. The administration is trying to find a loophole is what this is.

Yes revoke anyone's citizenship who joins ISIS. That or death. That's where I stand.

Let me put in a devil's advocate here

"revoke anybody's citizenship who joins the democrat/republican party"

Yes I know it's a stretch but like I said, do we really want the government revoking citizenship as they see fit?

I still say execute her. But don't revoke citizenship.

Execution is not the proper punishment for treason. Too much Hollywood there buddy.

18 U.S. Code § 2381
Penalty for someone found guilty of treason is 5 years in prison and a minimum $10,000 fine.

flag link military_tech thumb_downthumb_up

Aiding the enemy?

Feb 21, 2019, 9:53 AM

I'm sure we can find something that carries a death sentence.

Feb 21, 2019, 10:02 AM

Nope. Doesnt exist in our penal code. Cant prosecute people for things they did overseas unless done with the UCMJ, but that would require you to be in the military.

You didn't quote the whole paragraph :

18 U.S. Code § 2381:

"Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States."

How long has she been out of country? Long enough to have 3 ISIS husbands and a baby...

flag link military_tech thumb_downthumb_up

well, the life expectancy of Jihadi husbands is short

Feb 21, 2019, 9:36 AM

very short

and a traitor to her country.

The debate is do we revoke her citizenship and let her live in another country or do we keep her citizenship, bring her home, and try her for war crimes?

Haven't they always been able to do that, within prescribed

rules and parameters? They can't do it for no reason, or because they feel like it, but I thought they had the ability to revoke citizenship in certain cases.

I would agree with your take but...

You do know that the crime of Treason only carries as sentence of 5 years in prison and a minimum $10,000, right? Not execution...

18 U.S. Code § 2381

Feb 22, 2019, 9:19 AM

We havent had someone convicted of treason since 1952, and we havent executed anyone charged with treason since the Civil War.

Yeah, totally practical that we waste millions of taxpayer dollars to off some crazy lady that moved to an oppressive country that hates women to be a cheerleader for a glorified gang that has very little ability to actually harm the greater homeland of the United States.

flag link military_tech thumb_downthumb_up

An interesting topic. What would we have done during WW2

Feb 21, 2019, 11:00 AM

if someone went to Germany or Japan and joined them and promoted attacking America? Would we rescind their citizenship? Is that a good analogy?

flag link military_tech thumb_downthumb_up

Re: An interesting topic. What would we have done during WW2

Feb 22, 2019, 9:27 AM

No, we charged them with treason and imprisoned them.

We only charged and convicted 6 people of treason during WW2. None were executed. All were sent to prison.

1 served a life sentence
1 served 12 years of a 30 year sentence.
1 was supposed to be deported to Japan, but was pardoned by Kennedy
1 was convicted but later pardoned by Ford
1 was convicted in 1944 but was paroled in 1960
1 was convicted on a 6 year sentence in 1949 but passed away in 1952 due to an illness.

The US hasnt executed anyone for treason since the Civil War.
Since 1952, no one has been charged or convicted of treason in the US.
Edward Snowden, who was a hero, was never charged nor convicted.
Bradley Manning was convicted of Espionage.

Let them cut her head off in the square, once they find her, and save us time and money.

End of story. Move on.

capture her and escort her back to ISIS and let them teach us how to receive a traitor.
