Judging by the challenges to the GoR by FSU, many of them fall on Swofford himself.

1) They claim that Swofford hid material information from ACC members in order to gain approval of the GoR.

2) They claim that Swofford (and others) breached the contract by not acting in good faith to maximize payouts to institutions

3) They claim that Swofford (and essentially ESPN) conspired together to make the penalties too high to create an anti-trust situation. This is probably more of a shot at ESPN, but also Swofford in that he was the driving force behind agreeing to it.

In the end, Swofford may have messed up so bad that it ultimately cracks the door for the GoR downfall. If that happens - is he still the villian or do we actually thank him for becoming a Villian that we end up celebrating due to their character flaw becoming beneficial?

If it plays out this way we can build a Swoffy statue on campus for providing an out from this agreement.

It still surprises me that university leaders (many with business schools) would agree to such a long-term commitment.

They thought they wanted what the SEC had -a TV network and gave up our rights for 20 years for the crappy ACCN so we could watch reruns of Coach K biographies and spurtle info commercials.

The individual representing ABC/ESPN during the time of this agreement was identified as a UNC alumnus. That shenanigans are alleged to have occurred should therefore come as no surprise.

If FSU makes a case that Swofford is/was an incompetent tobacco road bumbler who conspired with ESPN to screw the football schools, then we should all be thankful that the courts finally see him for what he is.
