Retention of classified materials by a VP or Secretary of State is categorically illegal. Of this, there is no wiggle room, it is cut and dried. Yet, as long as those criminals are Democrats -or- establishment Republicans, then all is forgiven.

Article 2 of the Constitution provides the legal basis for an ex-president to retain classified materials which he had acquired when he was president. Presidential Records Act challenges Article 2, yet the precedent for enforcing the Presidential Records Act is to … not enforce it.

Cut and paste from The Post Millenial - August 11, 2022.

The act was enacted into law in 1978 following the Nixon residence, where he claimed that his secret Oval Office tapes and other personal records were his own personal property.

The Lyndon B. Johnson Library had delayed in releasing the final batch of his secret tapes until 2016. This came 47 years after he left office.

In 2001, then-President George W. Bush issued an executive order that changed the act from guaranteeing public access to the documents to one that blocks it, though Congress overturned parts of the order in 2014, according to Bovard.

Politico reported in 2014 that Obama administration lawyers had repeatedly invoked the Presidential Records Act to "delay the release of thousands of pages of records from President Bill Clinton’s White House."

At the end of Obama’s two-term presidency, he reportedly trucked 30 million pages of administration records gathered during his time in office to Chicago, where he promised to digitize them and put them online.

seemingly don't have. I mean we post "gotcha" stories all the time about some politician being bribed with a $20k vacation, or insider trading nets them $50K in stock profits, or whatever else. But if you really think about it, 535 people control over $4 TRILLION dollars, every. single. year. And all it takes is a $20K vacation, or a free stay in some rich dude's summer cottage in Europe, or a free ride on some guy's jet or yacht, or some insider information on a stock, and all of this is SMALL CHANGE compared to the money these "corrupted" people control.

With Trump having left office, suddenly the National Archives makes a national security crisis about Trump’s retention of classified materials (setting a precedent by making, for the first time in the history of presidents who have routinely maintained possession of classier materials after leaving office).

Since leaving office ~ 7.5 years ago, Obama has had his ~ 30 MM of confidential records in his personal possession. (if they weren’t confidential, then there’s no reason for Obama to not share them via electronic copies with the National Archives for custody.). I know, I know, Obama only has in his possession 30 MM of private-only documents; none pertain to his role as president. Right..

Dang, with that many personal-only documents, his personal time (when did he have time to do any work as president?), personal time must have taken up his entire time as president. 30 MM pages of personal documents … that is one heck of a schedule for setting tee times and having rendezvous with his boyfriends.

FOIA requests for these documents have been spurned by Obama for years; the courts don’t care … since the Democrats had not filed those FOIA requests.

Two tiered system of justice. This will catch up to and burn today’s leftists one day. When that day comes, you lefties will never know what hit you.

The actual law has nothing to do with whether the news media, bureaucracy, or the general public thinks the law should be.

The president, like it or not, has the constitutional authority to possess any and all classified materials, and at his whim may declassify those documents. The president does not have to tell anyone that he had declassified those documents. He has Constitutionally authorized, unilateral privilege, of doing so.

Why is this? Because, The Constitution defines, as one of his roles, the president as Commander in Chief. The president is this country’s supreme authority on all military and national security matters. He reports to no one in this role, nor does is he required to communicate with anyone in this role. In this particular role as the supreme authority, all confidential materials are primarily to provide information to him so that he can best protect the country.

Remember, General George Washington was our first president. This set in motion the path by which The Constitution was written to provide the president with these unique powers.

Back to your question. Do I LIKE it that this presidential right to possess, and then keep classified or declassify materials at his whim is a good thing in today’s complicated times? No. I think this is terribly outdated, since in the ensuing ~ 250 years, we have had a plethora of presidents who know neither know anything about the military or about how the capability of military (I.e., at his time in office) to achieve their objectives.

Who on earth thinks that Biden, Trump, Obama, G.W. Bush (a lightweight who got into the National Guard in order to avoid dangerous military service via the draft and end up in Vietnam), or Clinton had a clue about military matters other than what their staff, cabinet, and generals & admirals tell them.

(*). But The Constitution is the foundation of our legal system, The Constitution bestows the responsibility of Commander in Chief on the president, and, with respect to ALL confidential materials, the president has unique powers to deem them as classified or declassified. He answers to NO ONE on this; that is why neither Clinton, nor G.W. Bush, nor Obama, were ever pursued by our government for possessing hoards of classified documents after leaving the presidency. Obama still has his pile of such documents; the National Archives continues to beg him for electronic copies of Obama’s documents.

Yet, the government indicts Trump for possessing confidential documents.

This is a political witch-hunt. Nothing more.
