In 2014, Maryland paid 31 million dollars exit fee to the ACC. That amount today is equivalent to approximately 41.7 million dollars. The precedent has already been set with Maryland. Clemson needs to hang in there and see this case through. You cannot force someone to commit suicide. Not only is the ACC wanting to force Clemson to suffer a slow, painful suicide, the league is providing the gun by acting in bad faith (recent CFP money agreement). All it takes is one judge to force this thing up to the Supreme Court. In all of the league documents and emails, there will be something to help Clemson. If Swofford’s son did profit in a way to hurt the conference schools, Clemson wins.

Maryland took their media rights with them. The league had a media rights deal in place when Maryland left and was amended in 2016.

If we're simply asking for a declaratory judgment -- and it appears we are -- why is the ACC countersuing us for financial damages?
Appears to me we're just asking for them to provide us with information. And if their response is not just "No," but "No and we're going after you for financial damages," then they REALLY must not want the info to be made public.

They know the valuation of Clemson, FSU, and UNC is substantially more than the conference negotiated.

You know the ACC has to counter sue against Clemson just as they are doing against FSU. The ACC got screwed up when Swofford did all of this trash stuff years ago. I would be surprised if the Tarheels sue also because they are also a charter member and Swofford years ago was their AD.

The exit fee is not the problem.
The decade+ remaining on the GOR is the problem.

That is PRECISELY the point. By forcing discovery, at a minimum we will put daylight on the horrible media deal Swofford put together. As of now, nobody has been allowed to see the details. Retaining our media rights is the first (and most important) step we need to take before any serious exit discussions can occur.

Maryland's exit is what drove the ACC to establish the new exit/GOR deal.

Clemson and all ACC schools have been agreeing to the GOR deal every year when they cash the GOR check they get. When they do that, they are putting a gun to their head. ACC isn't making them cash that check.

When you cash the check you've agreed to the terms of the deal. Thats how it works. If your plumber fixes your toilet and accepts your payment then its a done deal. This is contract 101.

This is not a toilet install. When we signed the contract, we agreed to the deal. "Not cashing the check" is not a way out.

There is no GOR check. The check is from revenue sharing which would exists with or without a GOR.

Regarding Maryland's leaving that had more to do with Jim Delaneys brass balls hood winking the networks into buying that Maryland was worth millions more than they actually were.
