While the ACC managed to get comparable money to the SEC & Big Ten for its main TV rights, the league signed away all of its third tier rights to ESPN as part of the deal for essentially nothing. ESPN then sub-licensed those to Raycom Sports for $50 million a year that it did not have to share with the conference. This was done at the behest of then-ACC Commissioner John Swofford, who wanted to keep Raycom as an ACC TV partner above all else in TV negotiations. Swofford maintained it was due to Raycom’s long standing relationship as a media partner with the ACC. However, Swofford’s son was a Raycom executive and maintaining the rights to the ACC was a necessary lifeline after Raycom had lost the rights to the SEC the year prior.

....what fans of ACC teams have known for a decade. Swofford cut a sweetheart deal in order to profit his son.

That is one of the major points that the suit is citing to show Swofford did not act as a fiduciary, which was his legal obligation, while negotiating the TV contract with ESPN (either the original or the subsequent amendments).

I would love it if he were sued civilly or if this resulted in some criminal prosecution. I'll bet the tarhole weasel has something from the conference indemnifying him when he retired

This particular point isn't going to work. Back then, it was common for ESPN (and other networks) to syndicate games. That was true of other conferences. The ACC just got ESPN to agree to syndicate the games exclusively wirh Raycom. This argument is going to lose.

All the ACC schools that signed this deal under Swoffie should follow suit (fsu), sue both ACC, Swoffie, and maybe find a way to sue ESPN for negotiating schools TV rights away for $50mil a yr with no payback to schools.

2036 is a long ways away. Something has to change before then. ACC schools will be $650m - $1bil behind the SEC and BIG in the next 12yrs if nothing changes.

There are 7-10 schools who know there is no way they deserved as good a deal as they got. That’s the big problem with the conference. Hangers on.
