“UPDATE, 10:47 a.m.: Twelve ACC members were at the meeting that approved of the amended lawsuit against Florida State, the conference’s attorney said during the hearing. Clemson was invited but didn’t attend. FSU was not invited. It’s unclear whether those 12 members included non-voting incoming members (like Cal or SMU)”

Does not matter in which state it is in...copywrite law, patent law, contract law, statute of limitations covering those laws and estoppel laws are the same in every state...there are no special laws for crybabies in any states...this is all aproduct of NIL, portal and pandering! I do not think Clemson would do this without those issues..FSWTC would have anyway...they are much more valuable than all the others...ask Jimbo and Willie T. We have now left our ACC friends and joined the savages!

Florida judge is not letting that happen. He is ruling right now the ACC's lawsuit was "preemptive anticipatory forum shopping." He cites that case law generally goes against forum shopping. He thinks the ACC filing suit without a vote first is strong evidence the ACC's suit was filed with "forum shopping" as the main goal. He also is ruling that the Florida public records act (sunshine law) is unique to this case, and a major difference between the case being tried in NC and FL. He has intimated he does not think the ACC argument to keep contracts (ex. ACC-ESPN) out of discovery highlights the difference in the two states. He is ruling largely in favor of FSU's position that their case needs to be heard in the Florida courts. He gave a strong plug for mediation in closing.

Excuse me. Meant to say the ACC interest to keep contract out of discovery DOES highlight how it may be treated differently in the two states.

In other words, it sounded to me like the Judge anticipates that Florida's sunshine laws are likely going to require discovery of things the NC case would not allow...things the ACC does not want in the public square?

I agree. It was fun listening to him as he was speaking. I could feel the "ACC" squirming when he started the "pep talk" without making it a "pep talk" on mediation.

He made it clear he was not ruling on the merits of FSU's case, only if it should be heard in a Florida court.

He even went into his extensive background in mediation as a judge and attorney! Clear to me he will be pushing a mediated settlement. Who really expects anything else? I think he let that be known rather clearly with his "non pep talk."

Would a judge's ruling in FL to make the ACC -ESPN contracts public per precedent, prod the ACC into settlement negotiations? I guess it will depend on what ESPN and Swoffie tell Phillips to do.

maybe. But I think once more weight is brought to bear (don't want to go into specifics) the ACC will realize that its better to get the best deal while you can. JMHO.

Personally, again, JMHO, I think it will turn out easier to leave than most imagine.....when its all said and done. Once the acc starts taking on water, watch the rats (not clemson or fsu) jump into the fray to jump off the sinking ship..........

The level of toxicity b/t fsu/clemson/other schools and the acc will only rise as time goes on. Same with fsu/clem and the leeches of the conference. Just like a bad divorce.....

wouldn't be part of the team. ESPN would claim ignorance and Phillips would turn Swaffie out as the scapegoat.
