NIL. How do you put the toothpaste back in the tube?

I don't think you can.

SCOTUS has ruled that colleges cannot limit students from earning money on NIL. So, how can any school or conference or the NCAA do something like put a salary cap on a university?

It appears to me that the court ruling essentially means the college can limit how much money the athlete gets from the school, but cannot limit how much money the college gets from outside sources.

It seems similar to an NFL player making commercials and getting paid by whatever company has hired him. There is no salary cap in any pro sport that says, "The total income of all the players on your team cannot exceed X dollars." So, how could universities do anything like that? Say, the ACC passed a rule saying, "The total amount of money given to all the athletes at any one school by a collective cannot exceed $2,000,000." I can't believe the courts would rule that constitutional. A collective is not governed by the school, is not affiliated with the school (wink, wink). It is a private entity.

Say, Ping sees a HS senior who is "the next Tiger Woods" or "the next Jordan Spieth." How could the NCAA say that Ping could not sign the kid to a 10 year contract saying, "As long as you are in college, we will pay you $1,000,000 a year. When you turn pro, we will pay you $10,000,000 per year. But, you have to play our clubs and appear in 5 commercials we will produce."

What rule can the school or conference or NCAA make that says that kid is ineligible to play for that school?

I don’t think you can either.

It will be difficult to ever regulate. Unless NCAA or states set rules and then work their way thru the courts.

Does NIL apply to high school as well? I don’t think so, but I think it would if challenged

I'm telling every company or person involved with any NIL's with my players that there must be wording in their contract that states that the player is paid per quarter that they play. Then the NCAA could not suspend any players for a half because of targeting since the SCOTUS has made it illegal for the NCAA to limit students earning money. Suspending them would cause them to lose money, which is illegal.

Are you referring to the week useless NCAA who should have strictly enforced more rules , focused on the right priorities and refuse to have sold their souls for the almighty dollar !!!

I wonder how long it will be before $$$$ destroys HS athletics. Parents have made involvement in youth sports unenjoyable even for the kid’s. When I was coaching youth sports I ask them what one thing I could do so that they enjoyed playing the game and having fun. Everyone of them said they wish their. Parents would not come to the games. That is a bad reflection on parent’s , but IMO it’s a true statement

I also wonder how much longer Dabo will remain in coaching?? Based on his Character, Ethics and Integrity will he continue to work in a toxic environment created by NIL and the TP.

As the drama within college athletics increases my interest decreases. Sports has always been very important in my life. It was something I really enjoyed playing and kept me out of trouble. It taught me discipline and how to interact with different race’s. It was a way to escape work, politics, and other social and personal issues. I could not wait until Saturday because my daughter and I would have plenty of food and would watch college football all day from 12:00 pm until the teams on the west coast finished. It has been a great bonding experience.

Sorry this post turned so negative it just went down that rabbit hole. I hope my feeling’s change when Clemson’s football season starts.

Why is everyone so obsessed with NIL? Athletes are just like those of you that still work, you have every right to earn money and now so do athletes. Some jobs pay more than others and some athletes will make more than others, in fact, the vast majority of athletes will make a big fat 0. Even football players in high schools have received money after games just by shaking hands for years and high school sports did not die. College sports are not broken so let's at least give NIL a chance.

It might be. That would mean the guy couldn't play in any USGA event. But, I don't know the rules for USGA on amatuerism for sure.

You make a good point. But, it doesn't change my point that the NCAA nor the university could declare the player ineligible.

Just put the sit out year back into place for transfers but don’t take a year of eligibility away. That at least changes the Addison situation. For the A&M situation, you need to add some sort of change to recruiting rules to require disclosure or something like that so at least it’s in the open.

The ncaa governs the eligibility rules so maybe there is even a salary cap angle that you can only have $X million of NIL on your roster. Thus, you aren’t limiting any individual earning potential per se, but you are potentially creating parity between the schools.

Toothpaste will no longer be in a tube. In other words, they will figure something out because what we are doing is not sustainable. When you factor in that 97% of college atheletes never make it to the pros, and that 99% of college presidents, atheletic directors, and coaches don’t like what we have now, they will figure something out.

SCOTUS didn’t rule on NIL

The Alston case was about limits on education related benefits.

What happened was states, starting with California, passed laws allowing NIL. This originated with another case where players sued for having their likenesses included in video games without being compensated.

The interim NCAA rule had some limits. No NIL related to alcohol, gambling, tobacco, marijuana, or prostitution. If it ever goes to the Supreme Court, they will likely rule that it can be regulated on content such as these examples but not capped. Similar rules already apply to professional athletes.

Not that anyone cares…. But I think that if any student athlete receives any kind of recognition for his exploits on the field from any product or agency the SCHOOL should receive the compensation and allow them to dispose them the money as they seem fit. For instance, IF
DJ is used in a NIKE commercial payment should be made to Clemson and the university decides who gets the money and how much. In a situation like this if the sponsor pays a million dollars for the rights Clemson gets the million and could give half to DJ and divide the other half to the remainder of the team . This could allow the university to receive some revenue also. Remember these players who are able to get this kind of recognition are a part of the university that supports them!

I agree there is no going back. Once you cross that line it becomes easier and easier to cross it again. Eventually you want step back across that line which guides our moral compass. It reminds me of the saying “ You can really never go home again. It’s just not the same”

College athletics will never have once was some sense of innocence.

What makes me really sad is that IMO we may have seen the best years of Clemson football the years under Dabo. I pray that I am wrong. If anyone can guide Clemson Football back to the top it’s Dabo!

How many who were in favor on NIL see it as the worst or one of the worst things to happen to college sports??

There is one thing I feel confident about is the coots will still be the same old dumpster fire they have been for 100 plus years.

The NCAA lost control for good with the 9-0 SCOTUS ruling. The toothpaste isn't going back in the tube. The pre-NIL days are gone forever.

The best thing to do - especially in football - is to start maximizing our use of NIL to get - and KEEP - the players we need, especially at key skill positions.

Stop trying to figure out ways for the NCAA to regain control. It's not going to happen. The NCAA will be lucky to survive this.

It's pretty easy to predict that the P5 and maybe the AAC will leave the NCAA and form their own professional football league. A players union and a salary cap are the only legal way to make a dent in this situation.

They're going to have to figure someway to get the kids under contract.

It isn't sustainable in its current structure. Not even the NFL could survive 100% free agency every season.

Thanks to all who replied. My conclusions/predictions/guesses.

1. You can't put the toothpaste back in the tube. NIL is here to stay.
2. College athletics will look a whole lot different in 10 years than it does now.
3. Colleges will adjust, but won't stay the same.
4. I have no idea what those adjustments will be, how the structure will look, or what the recruiting/transfer/academic rules will be.

given by any single company or LLC to a certain amount of money per year. Maybe 100k or something.

The kids can still make great money, but it will prevent these huge deals and deals where X BBQ company pays 50k to every lineman every year etc.
