The perjury trap is set

Oct 13, 2022, 11:32 PM

Jan 6 committed subpoena’s Trump.

This is going to be hilarious. Trump will own them, then they’ll accuse him of perjury and try him in DC, that jury will find him guilty. Will be interesting to see what happens then.

To what court will be hearing the appeal?

I really don't know if next stop is SCOTUS.

Non-lawyers such as me will learn soon enough after the DC court venue (with its jury comprised of 90%+ voters who are registered Democrats) hands down its 'Orange Man Guilty' verdict.

I doubt Trump ever appears before this committee

Oct 14, 2022, 4:47 AM

Trump may say he wants to talk to the J6 Committee (I think this is Trump spouting BS) but he will not submit to this Congressional subpoena if for no other reason than to protect the Office of the Presidency (past, current, and future Presidents) from Congressional overreach.

On principle alone Trump has to refuse this subpoena on a separation of powers grounds and force the Congressional Democrats hands on the issue. If after Trump's refusal the Democrats push this subpoena further it will ultimately work its way to the SCOTUS for final adjudication.

My guess is that if it ever makes it this far the SCOTUS will ultimately affirm a separation of powers and that Congress cannot compel testimony from a former or a sitting President. If the SCOTUS were to fail to affirm this separation of powers it would essentially mean that Executive Privilege does not really exist and the Office of the President will become a lessor and no longer co-equal branch of Government.

Ultimately I think it is one thing to subpoena and question someone from the Executive Branch about conversations they have with other Executive Branch members to include the President but it is a complete different ball of wax when it comes to the President themselves. Executive Privilege doesn't necessarily extend to all members of the Executive Branch or their Executive Branch activities but one can make a good case that all conversations/activities of the President themselves is covered by Executive Privilege.

LOL. The thought of Trump testifying under oath terrifies the MAGA comrades. They make up any narrative to protect their corrupt cult leader. They don't believe in "law and order", nor do they believe in upholding the constitution or "drain the swamp".

Re: I doubt Trump ever appears before this committee

Oct 14, 2022, 7:29 AM

Trump's actions and inaction on Jan 6th were inexcusable, but I too doubt Trump appears before this committee nor think he should for the reasons given by Tabby.

Now if the DOJ wants to pursue charges against Trump and in a court of law, attempt to prove him guilty of a crime, go for it. That will be a harder nut to crack than a lot of folks realize, but that's where this should be decided, not in the court of public opinion in front of the ever truthful Adam Schiff and Jamie Raskin. I guess Adam has all the Russian collusion evidence in Al Capone's safe.

This subpoena is nothing but political grandstanding.

It's time to put up or shut up in a court of law. Let the chips then fall where they may.

What were DJT's actions (i.e., facial expressions, messages tied to pigeons, Tweets, etc.) on J6 that stimulated the (limited, considering the overall crowd of 120,000 peaceful protesters) dozens of violent people?

I've yet to hear the first piece of credible evidence to this effect.

He should testify in front of the committee just like Hillary did for Benghazi and set the record straight, correct? Hillary broke Gowdy, so why would DADDY pass up an opportunity to break this committee?

You wouldn't be convinced if you saw him pointing a gun at someone.

The police estimated approx. 2000 entered the capitol and or engaged in violence.

Since the US has a population of 330 million, that number of violent people storming our captiol in order to stop the peaceful transfer of power in an effort to overthrow out govt., is almost meaningless.

Yup. The perjury trap is indeed set.

Now all the Committee needs...is for Trump to wander in and commit perjury.

Brilliant, 3D-chess-type plan, there. And those guys on the curb outside the Capitol with cattle prods and tasers, those are Trump's lawyers, who are one and all committed to not letting Trump wander in there. They seem kind of freaked out. Gosh, I wonder why?

The standard for proving perjury in a courtroom is actually quite specific. You've gotta work hard to walk yourself into a perjury charge.

I understand it's deeply confusing to you since you couldn't tell the truth to save your own life, but that's actually how it works.

There's a bunch of elements they have to prove to win a perjury case in court, and the legal bar is fairly high.

Granted, Trump is more than good for ticking every last one of those boxes, and often within the same sentence.

Again, you do realize that Jack Nicholson, like Michael Douglas in Falling Down, is not the hero in A Few Good Men, right?

They are really, really good examples of people who end up being bad guys because they are trying so hard and uncompromisingly to do the right thing they end up doing it the wrong way, and becoming everything they actually think they're fighting against. The term we're looking for there is "hubris".

I mention that because the example may apply.

The perfect Trump supporter. Before Trump even testifies he's already a victim. The game is already rigged against him. Has it ever dawned on you that Trump might lie? If he doesn't lie, he can't be charged with perjury.
