Claiming that extensions were signed off by commissioner only. And stated commissioners relayed false information to schools. That is a wild claim, and i could absolutely see Swofford doing this. Went to the point where the contract was essentially guarded by the ACC. Just a bad look.

Unreasonable penalty. Stating that it is common to have penalty for an exit, but it must be reasonable penalty. I agree with him on this as well. You cannot file a contact for lawn services and then set extensions with a 100 million dollar penalty fee. It is not reasonable. 600 million dollars is 100 percent not reasonable.

Breach of contract. This one got a little dicey for me. Not sure they have a point here.

Other items as well, but the first two are pretty eye opening

-only the exit fee might be considered such and that's what $120 mil?. The bulk of that $600mil you refer to is basically that FSU sold/assigned their media rights to the conference for x amount of time. That is not a "penalty". You sold something, now you no longer own it. You want to buy it back? it's going to cost you that to buy it back unless the person you sold it to agrees to reduce(assuming they are willing to sell at all). I think this a loss for FSU or anyone else. The first item that you mention is what they are going to have to prove and win on IMO.

From what I gathered it’s not termed a sale of rights in the contract. That’s taking what David was telling the board. He used the term penalty.

I think breach could be legit. Of course it depends on the language in the agreement. I sure hope it included stipulations for each member and I hope some of the members did not 100% live up to their end of the bargain. And I hope the ACC failed to enforce to the letter of the law. And I hope that it can be shown that the ACC failed its fiduciary responsibilities.

A lot of "hope" in there but we'll see. Glad Florida has sunshine laws. And don't put it past the Florida Governor to ratchet things up in Tally gubermint.

Who cares right now - And our ACC Commissioner is very weak on the network and national scene! He should be fighting like the dickens right now with the networks for a renegotiated and much improved contract to benefit all ACC teams - I do not think he has it within himself to do so!!!!
