My take on GOR

The grant of rights signed in 2013 and renewed in 2016 was a pretty unprecedented document. I can’t imagine that any person had the enumerated right to essentially give away Clemson’s rights to a third party. It’s a lot different than a media contract. There are no guaranteed returns via the GOR whatsoever as I understand. The state attorney general should sue the ACC on the premise that no party was authorized to sign the rights away as they did. This would probably require some folks who were party to this resign / be fired. I know the Board of Trustees acts on behalf of state interests but this was an unprecedented situation and really doubt anything in their charter covered something like this. And the state legislature should immediately approve a method by which such rights can be contracted (so it’s not an impediment to a new contract).

Sovereign Immunity, b/c the document fails to address which court/state has the right to enforce it. They believe their state legislature can simply give them immunity from Florida courts.

From the moment it was signed it has bugged that anyone, President or AD, would have unilateral authority to sign something like this. If it required official approval from the board, where does that specific authority come from. Are any of those parties authorized to simply give away any of Clemson’s assets as they see fit? Because it is what they did. And if State AG would go this route it would open up discovery. The ACC was supposed to represent the members’ interest. If there is a single email to be found where anyone on their end was taking direction from ESPN on how to sell this, you have another avenue to void the deal and probably add damages to the matter. Dig far enough you might get to criminal fraud since you’re essentially stealing from a state institution.

It still amazes me that everyone voted to extend in 2016 for 20 dad gum years...especially Clemson. I just don't understand why we voted for it again in 2016.

University Presidents, Boards Members, and Athletic Directors frequently embody this. There is no real career path for these type jobs. Just who sucks up the hardest at the exact right moment.

The problem is that Clemson did sign the contract. Not only that but they knew the terms and length of the contract.
I hate that Clemson made such a bad decision but now we are bound to the terms and length.
Instead of blaming everyone else, there needs to be some heads roll at Clemson.

Clements was there for sure in 2016. Not sure about the board. Certainly some carryover. Which is part of the rub. People complicit with this nonsense are the ones that need to be pleading for action. IPTAY is (somewhat) independent. If they care about the future the need to pay an economic loss expert to forecast the damage the GOR will cause if it remains in force for 13 more years. Would probably be very eye opening. Well in excess of a billion dollars. Much more if you account for the economic development that will dry up if the ACC is relegated to an FCS type status.
