SC Justice Gorsuch's law clerk said there is NO way Trump can be charged for having declassified docs in his possession. When the docs leave the WH they are automatically declassified, period!!
This hoax is right up there with the Russian Collusion hoax as well as the Telephone Call with the Prez of the Ukraine hoax!!

If he had declassified or downgraded any of them, it would be obvious to anyone familiar with classification markings. He didn’t do any such thing. It’s a good thing that all of his moron followers who don’t understand this will never be granted access to similar information.

That’s right he can. But he did not.
There is a process. Last week when one of the Trump White House aids was asked if there was a process or a “standing order” to declassify documents, they hesitated and then said “I don’t know of there not being a process”.
That doesn’t cut it gentlemen. The national archives and intelligence agencies do not work that way.
Trump had no process and he did not declassify the documents. Now once he is out of office he is attempting to retroactively declassify documents. This dude is dumber than any of us thought.

He also can't declassify TS/SCI stuff since it by law constitutes "extreme risk to the national defense" and taking it out of the skiff in which it resides is supposed to be completely illegal anyhow, much less taking it to an unsecured civilian home. That's undoubtedly what got the "espionage" suspicion added to the warrant. God help him if he was shopping that around.
Also, the president cannot declassify nuclear secrets. That takes the Department of Energy, and it did not and would not happen.
Also ALSO, it doesn't matter a sweet #$^& if he declassified anything anyhow - though he didn't - because again, anything he did that imperiled our national defense still falls under the espionage act anyhow.
Lots and lots of people have gone to jail for that...for WAY less than what Trump took.
He's hosed.
