oh by the way. The trooper turned the camera off but found pot, a gun and only charged Dyer $17 and let him go. The trooper concealed the weapon and pot. Dyer was dismissed from team yesterday. This is the guy that broke all of Bo Jacksons records at Auburn as a freshman. Now he will probably never see the field again.

Serious question for any Tiger lawyers or cops. What transpires in this video that gives the cop the authority to begin a search of the vehicle? I'm not sympathetic to Dyer but I don't see where anything other than routine speeding took place. Obviously he got caught blah blah blah. But it seems like clear cut profiling which is not supposed to be permitted. I'm really asking out of genuine curiosity out of the technical aspects of an arrest like this. Not looking for some big moral debate.

I drive with a heavy foot and have been pulled over more than a dozen times in my life - picking up a ticket about half the time. I've been pulled over on the interstate, in the city, and in rural parts of this state, Georgia, and Florida (I travel a lot). On one occasion I was told I was pulled over on suspicion of DUI (I, fortunately, had not been drinking) and was administered field sobriety and sent on my way. On no other occasion have I ever been asked to exit my vehicle or if they can search my vehicle. I've been stopped going in the 90s on the interstate. I've never been issued anything but a ticket and sent on my way.

u sure this is the same incident about the pot and gun. if it was the cop would have shown it for evidence and took him to jail. not just gave hima ticket and let him go.unless they didnt show it and that was dyer on the side with the white girl let his buddy which was driving go. either pretty strange GO TIGERS!!!

Same video. Cop turned off camera when he found gun on dash. This cop did so much wrong.

probable cause is not always a necessity. Based on suspicion alone, the officer can simply ask the driver for consent to search the car. If the driver consents, the officer needs no additional cause, and the officer can conduct a full search.

If there is probable cause (the officer either see something or smell something that leads him to believe that evidence or contraband may be located in the vehicle), consent is not required. Even the actions of the suspect are enough to create probable cause.

this ... ^ Never consent ...ever....When they attempt to detain you, ask if you are under arrest. If they say no then thank the officer for his time and drive off.

With that said Im not sure what the laws in AR are, but 96 in a 70 would be wreckless driving here in the state of MD and a felony.

But is it a catch 22 where denying consent immediately triggers probable cause? I would think you'd either have to state your probable cause and initiate a search or ask consent. But, if you're asking consent that is pretty much an admission you don't have probable cause. I certainly don't know but this one is weird. Cop goes out of his way to turn this stop into something, finds what he needs, then sends him on his way with a minor ticket.

One of the times I was stopped I was in a borrowed car. The owner had left registration and insurance in an envelope on passengers seat. This was the time I was pulled for suspicion of DUI because I swerved over the line trying to figure out wiper controls in an unfamiliar car. After I was let go w/o a ticket, I went to put the envelope in the glove box and found a handgun that I knew nothing about. I can't help but think that would have severely complicated my night had they searched the car. It also reminds me that we never really know the circumstances surrounding some of these situations.

the officer may detain the suspects for a reasonable amount of time.

During this time, the police are likely to bring-in the drug-sniffing dogs. The police can allow the dog to sniff around the outside of a vehicle without any kind of warrant or any type of specific suspicion or probable cause. If the dog "alerts" to the presence of something, that creates enough probable cause for a full search, without consent or a warrant.

The "reasonable" amount of time provision is vaguely defined, although wait times up to 90 minutes have been allowed by federal courts.

consent to a search of the car the cop can do a full search, but if he asks to search even with probable cause you can say no and he has to get a warrant to do anything else to your car. Bottom line until the officer has a warrant he has no right to enter your car unless he feels your destroying evidence or harming someone

But it is BS. Cops can pretty much make up anything they want to and search your car. Once they have you stopped they can do what they want....and get away with it.
