Ugh! I by no means am a legal expert. Basically, the lawyer feels the Seminoles have the upper hand and that some sort of negotiation will occur, with FSU paying the exit fee of $120 million, along with a reduced penalty from $540 down to something like an additional $120 million. And if this happens, it might very well pave the way for others to follow, should they be willing. Of course, there is the question concerning landing spot. Where will FSU, or others, go???

Forgot to mention something else. The host and legal expert also spoke about locale, as in where would all of this take place, North Carolina (ACC Headquarters) or in Florida?

So FSU could pay $240 million plus not get a full share of conference revenue( i.e. SMU et al are limited for 9 years) for nearly a decade and this is the side with the leg up? Just like most, I don't have all the details, but anything similar to this seems like a tough deal for FSU

You are equating SMU with FSU? Really? FSU will land in a major conference, either B1G or SEC, with an equal share. Their brand value will add to, not detract from, whichever conference they join.

You must be forgetting that at one time before the toothless wh**e that is the ncaa gave them a death penalty SMu was a major player in the Southwest conference...just after Frank Broyles decided that TU winning the natty by beating Arkansas at Fayetteville...same kind of Testosterone rage as FSU..Texas won and ruined Frank's day! Arkansas got out of the SWC cause they could not beat Texas...aggies figured out the same thing 30 years later...idiots of a feather!

In my mind the negotiation wont be about how much a team needs tp pay to leave but a restructure of per team payout for each member

The ACC had better football overall this year and that direction needs to keep on keeping on

Time to quit giving top tier money to teams that dont try to play better football

And frankly, would make the crap teams even worse, thereby further degrading the quality of the already poor quality league. Hardly gives anyone an impetus to negotiate a better media deal at any point in time.

Since the attonrney is obviously a huge FSU fan, I am not sure how much credibility he has. I can see another attorney arguing the exact opposite ...... and they will. I am not an attorney, but have been involved in dozens of contracts. I always put an arbitration clause in all of my contracts, which is basically what this guy says is a clause that says FSU can't sue the ACC. Of course he argues that since the contract has probably been breached, then that clause in not enforceable. Quite often, the first thing my client's attorney wants to do with my contract is remove the arbitration clause. Why ...... because it settles the dispute without an attorney, which means no attorney fees. They don't like that.

As a Nole, I hope his interpretation is correct. But, as he openly stated, he is a major seminole fan. He's an attorney who graduated from FSU and has been a big supporter of FSU since before he graduated. (It was mentioned he was a member of The Animals of Section B. For any of y'all who have ever been to a baseball game in Tallahassee, you will have some idea of just how rabid those fans are.)

He is giving his legal interpretation from the FSU perspective. His arguments sound very reasonable and logical to me. I hope a judge finds his viewpoint just as logical and legally sound. But, I doubt it will be that simple.

He mentioned that virtually all civil suits are settled out of court in negotiations.

My best guess, strictly an uneducated one, is that the ACC and FSU will arrive at some mutually agreeable sum of money for FSU to pay (I'm guessing around 150M) to get out of the conference.

Here was something he said that I think explains the situation.

FSU has said, "We don't want to be in this conference." The ACC has said, "We don't want you in the conference either. Just pay us and leave." All that is left is negotiating the amount.

I don’t think Bret meant that literally ….. more like “if you don’t want to be here, then we are not going to try keep you”. I think that there are circumstances that FSU would be glad to stay in the conference. I hope it doesn’t become so toxic that it leaves a bad taste is everyone’s mouth.

When Maryland left the ACC for the BG10 it was reported they only paid 1/3 of a negotiated fee btw Maryland and ACC at that juncture in time. It pays Big Dividends to surround your school with the best attorneys in any legal case.

For the ACC to compete financially I see no other choice but to merge with the Big 12. What other options are out there?

Or if a few teams leave then the remainders would not need as much money and become something like the American or Sunbelt conferences.

If ESPN drops the ACC in 2027 at their behest the conference will become a shell of itself because of the poaching from Big 12, BG10, an SEC for some schools. Example: I've read the Big 12 are interested in Louisville, Pitt, Virginia Tech, and NC State. I've also heard that BG10 would invite FSU to get in the rich Florida market and its viewership among other positive avenues. I am hearing Clemson could wind
up in the SEC regardless of any objections from South Carolina which I am in favor of Clemson moving forward in SEC conference. Rough breakdown of 2024 revenue for each member of Big 12 upper $20MM range,
SEC upper $60MM range and BG10 low $70MM range. ACC 2024 revenue roughly $30MM range. So if ESPN bows out of ACC in 2027 ( reason I believe they will Disney their parent company will not have the funds to pay both SEC and ACC ) its whoever the ACC could find to partner with contractually but probably at a much reduced revenue rate per school. Hopefully Clemson is being pro-active in their future endeavors to
land in the best conference and IMHO that would be the SEC if they invited Clemson. Just my opinion based on alot of speculation this time.

Why is it that Dumbo Fishnets contract was ironclad and tamu has to pay it but the halfasxusemiholes don't have to honor a contract that signed more than once...allow this krud gravitated back to Bowden/Fisher/next few dogs and a bunch of losers who can't honor a commitment and once to be seen as very important! Some smart judge may figure this one out...what conference will really want FSU...Maybe the PAC6!

on pretense that FSU had such great accomplishments since 2010. My interest in the video ended when the talking head demanded that the ACC members on the POC hadn't 'fought,' for FSU.

That violates the heart of the reason the playoff system was adopted. It's not a political committee where each conference has a representative to fight for conference 'rights,' or the good of the conference(s). The main function is to select the four best teams to play and determine a national champion, the best football team in the NCAA's FBS league.

Previous to those idiotic and ignorant statements the guy made some good points. FSU, along with all the other teams in the ACC in 2013, I think, were offered an option with only one practical solution; pay 213 mil dollars to get out of the conference or sign the extension.

That alone reeks with the stench of extortion. Whether the law guy is telling the truth about this or not is the key to appreciating the circumstances of this situation. It makes me wonder if he had taken it upon himself to read the agreement or if he's just gleaned his information from others.

That's the big deal here because he is lobbying for public opinion which always includes spin. He's obviously like all of us who see an injustice but struggle to see that the ACC just doesn't have the viewership of either the SEC or perhaps even the B1G.

Don't get me wrong, I want Clemson out of the ACC and into a conference which will have other teams contribute to that conference's collective income.
