Commissioner Phillips is in a no-win situation.

If he votes for the system where SEC and B1G get more automatic bids than the ACC (and less money as a result) then he is hurting the ACC case against FSU.
FSU's arguments would include.
1. The commissioner just admitted that the ACC is not on the same level as the SEC and B1G. He is admitting teams in the ACC can't compete with those two conferences.
2. Once again, the commissioner is not acting as a fiduciary for FSU. He is accepting less money and less opportunity for FSU.
And Clemson, UNC, UVA, et. al. can say, "We want out, too. We agree with FSU."

At the time the ACC was desperate for a network like the Big Ten and SEC and would do anything to get it.

and the horrific physical and sexual harassment cases on multiple teams, it's really just amazing Phillips is employable at any position, much less as ACC commissioner.

Definitely a tough situation. It’s just prolonging the inevitable. Doesn’t ESPeNis have the right in 2027 to continue or break the current tv deal? They can continue to try to push and promote ACC teams for interest and ratings. But it’s obvious to most that the ACC (other than FSU and Clemson) and the Big 12 are miles behind the “Power 2” and the gap is growing. I read that the ACC and Big 12 are in a real precarious position. Either they accept what they think is unfair, or they get left out if/when the P2 decide they want to have their own championship. It’s a no win as described by the OP. I want FSU, Clemson, NC, and ND to join the B1G and get it over with. If the B1G can somehow, some way, with lots of hopes and prayers pull aTm out of the SEC, and maybe add GT, it would be beyond amazing. They would have schools in all the big talent producing states, and pretty much all the big market areas covered.

If you are speaking in regards to the lawsuit, it's not going to put him in a bad position. Florida state doesn't have a strong argument to begin with, but neither of these points help.
1. Admitting the ACC is not on the same level as the SEC and Big Ten is nothing new it doesn't change anything. The SEC and Big Ten were already well ahead of the ACC back when this contract was signed in 2013 or even in 2010. Florida State already knew that at that time when they signed the contract.
2. That second part is not true because he is at acting in the best fiduciary interest of Florida State and the ACC, as he's getting the best deal that's available. The ACC simply does not have the same opportunities as others to conferences. However, the fact that you signed a deal with another entity that doesn't have as much opportunity as other existing entities is not grounds to break a contract. Basically the Florida State's argument is "we signed a bad deal and we want out of it." Unfortunately, the law doesn't let you out of a deal just cause you made a dumb decision.

now. It doesn't really matter what they do, the last lifeboat has been launched, and the ship is going down. It only remains to be seen how badly the schools get dragged down at the end.
