“The sovereign immunity refers to the fact that the government cannot be sued without its consent.”

But the Athletic Department is not State funded. It is not a Government. It is orchestrated very carefully to not mix State funds so that there is little State oversight in Athletic revenue/expenditures.

It's still a state entity.

The athletic department is a part of Clemson university with state employees.

I thinkbthe OP and Chapin bring up some good points but I suspect your statement is most likely the most accurate. Though we know the Athletic Dept has access to a lot of money that would seem to be outside the university's control, what corn of corporate shield would exist to adequately separate the AD from the university as being an extension of the state govt?

This very same pathway is how Washington State avoided paying Mike Leach a huge judgement payout when they were successfully sued by him.

I stand corrected. I read something about it yesterday and the source claimed WSU, but no, you are correct it was Texas Tech.

It is the nuclear bomb but the card we have to play.

Any agreement with a future conference we get it signed off on by the SC Legislature so that the new conference knows we are not going to pull what we did to the ACC. It is the route to go and I hope we use it.

I’m no lawyer but that would seem to be a opening for us to attack…

I’m sure Clemson and Florida St are deciding when (this year or next or even 2026) but a fight in the courts is going to happen. It’s just a matter of when.
