CBS Sports weighs in more on ACC grant of rights

Today in seemingly conflicting lawyer talk, CBS Sports queried Kansas City sports attorney Mit Winter about the ACC grant of rights and came out with some interesting quotes. Winter is said to have worked on the Big 12 GOR that seems to be holding Texas and Oklahoma in place through the 2024 season.
On the ACC GOR, Winter told CBS Sports "It's definitely not ironclad," however, Winter added "It would be costly to litigate it and try to get out of it with an uncertain result. I don't think anyone actually wants to get involved in that fight. If they were to get out, they would just agree to some sort of monetary settlement, which would be a huge number."
Dennis Dodd estimates a figure "anywhere from $100 million to $500 million" for programs that find a worthy conference partner and want to leave. Winter told Dodd that "There is definitely no sure-fire loophole in the grant of rights."

That seems like really bad news for the ACC if the PAC and BIG12 combine and lock the schools in for a long period of time. Basically gives the ACC zero viable expansion options. Not that the teams those two conferences now have are great but the ones below them are definitely no option.

Brings up very good points. Exactly why I don't think the b1g or SEC will expand further. They have what they want. The ACC has either got to find a way to beat the b1g and sec teams or figure out a way to get more TV revenue.
Yes, we'll be competitive for awhile but unless something happens for more revenue, not sure where we'll end up.

I tend to disagree here. Sadly there are no moves or teams we can add that will help at this point. All of the big brands, besides ND, are claimed. I think the ACC will turn into the old big East and just be a basketball conference. We better hope we get a life line some where. The big 12/pac 12, if they merge, will easily be number 3, and us in the ACC barely a power 5/4 conference. That said if we go undefeated we should make the playoff even in the lowest tier conference.

Unless we think that somehow the Alumni at schools such as: Purdue, Vanderbilt, Northwestern, Kentucky, Indiana, Rutgers, Maryland, Illinois, SCAR, Minnesota, etc. will suddenly start caring enough about football enough to "just now start giving money to lure recruits to their school over a Clemson" then I think we are going to be just fine. Facilities speaking - perhaps they will be way better as the big money those conferences get **go to the school** not players. Perhaps the non-revenue sports at those schools get better uniforms and facilities - but the schools themselves cannot take that money from the TV deal and pay players to come there.
Why haven't they been under the table to this point? Money in the warm South is still money you can spend; rather than go get some money at a Big 10 school playing in crazy cold weather. Besides that: "it's still an 85 scholarship limit for the moment and you can still only put 11 out there at a time"!

over the past decade. I've read Football provides approx. 92% of ACC revenue, and Basketball provides approx. 8%. Clemson TV games, bowl games, and playoff game revenue has funded the athletic depts of most of conference teams who do not even make an attempt to compete in football. One-sided.
Where is the "opt out-clause" for universities who can make exponentially more revenue in another conference? We have read that it exists. Does it? There has to be some negligence options for Clemson's litigation team to go to work with ESPN's assistance (based on ESPN's interests).

That GOR was signed in 2013. An updated/revised copy was signed in 2016. We don’t know if they’re the same or not. Why no one can produce a copy of the current 2016 GOR is a mystery.

The ACC screwed itself in 1989 when they had a chance to bring Penn State into the conference followed by FSUand then Miami. The commissioner at the time (Gene Corrigan a UNC alum) didn't push hard enough for the required votes. If he would have been aggressive like Roy Kramer the ACC would be in a prime position right now.

Oklahoma State has a solid all-around program. Add Kansas for basketball. Yeah there's travel involved, but nobody expanding seems to be worried about travel. UCLA situation is going to get interesting. Pretty Boy Leftist Governor is pissed because he had to read about the departure to the Big 10 in the newspaper.

So one of the worst division 1 football programs in America when this entire discussion is being driven by football and Ok St….a program that’s won more than 8 games twice since 1970.

You're right about Kansas, but you are way off with the Okie St. stat. I didn't go back to1970, but they've won 9 or more 13 times since 1980.

I don't think anybody should owe more than the 30 or so million they get a year. If you had to pay 500,000 and got the 80 to 100 from whoever you'd still be making money by leaving. This is a 30 million a year relationship. Clemson shouldn't be called upon to cough up any more.
