Down here in Charleston someone made an offer on a house, a week before closing the survey was done. It was built 10 ft onto the adjoining lot. What made it even more unusual is that the seller was the Charleston county planning commission director! A $500,000 price reduction later the house was sold, the. Demolished and a new home was built on the lot.

Why in the world do people not do surveys?

Small price to pay to avoid situations like these. I know Spudagrees. And I guess title insurance doesn’t help in a situation like this, either, where it is a question not of title but of location of the structure. Cautionary tale.

But the Hawaii deal is mind boggling - the lot owner did nothing to contribute to the situation and is getting hosed. If I were her, I would seriously consider the lot swap with some compensatory damages.

half a million dollar homes. wouldn't spend $600 on a survey? It the attorney's can make her sell, there is nothing to stop a builder from just going and building on a vacant lot on Keowee with an out of state owner, and then saying, "Oh, my bad...well, I'll just pay you fair market for the lot".....That is a crock.
