I doubt a lawyer is going to enter into a contract like that. The lawyer has to represent the client, not the person who is paying. You are putting them in a tricky situation by asking them to protect your money while also representing the friend. It can be done but it isn't ideal.

And must have substantial evidence then sometimes the judge will make the defendant pay the attorney fees. But I can tell you from experience that getting a judge to order the other party to repay lawyer fees in SC is very very difficult. It’s never happened for me and I did have a lot of evidence and such.
Also is the spouse going to fight it for custody or would they just agree to child support by guidelines and judge browns custody? Judge browns is when the other person gets every other weekend and splits holidays etc. If they are agreeing to those things then it’s a simple hearing where papers have already been signed and the judge asked if they agree, not much cost here.

I also know of a woman that got thrown in jail for something (dui or a wreck of something) and was doing some time and got a divorce while she was away. She had half his stuff waiting for her when she got out...AND alimony for life.

Legal bills are ALWAYS more than you think they will be. Divorces can get extremely, extremely nasty, expensive, and time consuming. It may look simple: husband (I assume) is cheating POS who has abandoned the family? He will tell a different story. Even if he's lying, he gets the opportunity to tell it. And it will cost time and money to refute him. I would be shocked if it doesn't cost five figures.
If her situation is as bad financially as you say, there should be some lost cost or pro bono options. The best thing you can do is set her up with a lawyer who can help her.

And one day you wake up to find out you owe them money for the rest of your life. Who the eff thinks about that kinda liability when they are 18?
Kinda like banking and finance in high school...this is the kinda stuff that needs to be taught to the younger generation, if not in high school, then definitely in college. But getting a female teacher to teach males about alimony and divorce costs probably won't happen.

As ancillary advice seeing what my sister went through, go scorched earth and do not look back. Do not compromise. Do not show mercy. Go straight for the jugular and even after you watch the light go out in their eyes, hang on long enough to ensure the air is out of their lungs as well. A POS will exploit every bone thrown to them, and will use it to make the partner's life a living hell.

I just paid for my daughters divorce in SC.
If there are kids, the divorce takes a year, but if there is proof of cheating or physical abuse I think it can be as quick as 60 days.
Tell him to gather his proof of her cheating. She currently (probably) doesn't want the kids, but this will change once she discovers she'll be court ordered to pay child support.
Also, I'm guessing your friend will lose his place to stay if he's staying with her parents.
I won't tell you what I spent on her divorce...but she filed, had all the proof she needed...and 2 weeks later the COVID shut down the courts. #### thing dragged on for 2 years.

POS spouse will also find out you have at least partially funded the divorce and is going to take that personally. You never know what someone is capable of, I don't think I'd want my family involved in all that.

1) guarantees the cheating spouse won't get alimony
2) if the cheating spouses agrees that they have been cheating, it can result in getting out of the marriage in 90 days, vs requiring a year separation first. in SC drug abuse/alcoholism and abuse are also 90 days deals. Honestly, aside from the alimony thing, I'm not sure why every couple that has grown to hate each other doesn't just say they were cheating just to get away from each other faster.
I knew a girl who went through a divorce after being married for ~9 months. Her (ex)husband thought he was going to make some money out of it I guess (she was starting a job as a PA), and drug out the divorce to 18 months to finalize everything. All she had was school debt; I'm not sure why she didn't just say she was cheating to just to get away from him. In the end, I don't think he ever signed the divorce papers; I think the judge decreed the marriage was finalized as over and fined the guy for contempt of court.
3) Depends on the circumstances and the judge I guess..but if dissolution of property has come to the court (and not the couple during mediation) to decide, I guess one party cheating could sway that...even though its not supposed to.

Sounds like he's a POS and she could save a lot of time and money by not using attorneys to end up getting nothing out of him in the long run. If he doesn't have any money, and like you said payroll garnishments are the best she can hope for why spend the money.

Dude knows he doesn't have anything to lose, because he has nothing to take, and obviously doesn't care about those kids. She's wasting her time and Greenr®'s money chasing this dude down to maybe get some child support garnished from whatever weakass check he's bringing home.
My guess is he's working some throwaway gig that he'll quit/get fired from, hop to another state and get another job just like it, causing her to spend even more money tracking him down to go through it all again. Then by the time that happens...he'll be gone again.
Eventually, he'll prob get thrown in jail from a bench warrant because he owes her money...but how do you get money from someone who is in jail? If any of what I just said is true...she cares about him way more than he does. Her best option is to prove he is cheating and divorce him, get away from him in 90 days and move on. Sick the cops on him or child support if she wants, but they won't do anything about it.
