Could The FSU CFB Snub Be Grounds to Break The GOR?

I'm not a lawyer but it seems to me that the GOR that has the league locked in with ESPN (AKA The Puppet Master) is a fraudulent deal. When an ACC is perfect in season play and is left out of the playoffs to 2 schools that each have one loss there is a major problem with the deal.

I didn't realize part of the job of the CFP was to predict the future outcome of games based on some "eye test".

This snub will hurt recruiting for the ACC. Why would a blue chip player that has many options around the nation choose an ACC school know they are at a disadvantage? Sure, the playoffs go to 12 teams next year, but that just means the majority of the bids will go to the BiG and SEC.

at least going forward. And it could be argued that winning the ACC is easier than making the top 4 in the SEC/B1G (unless you are recruiting against Bama, Georgia, or tOSU)

I wouldn’t think so. The CFP committee is tasked with finding the 4 best teams. Someone is going to be left out that feel like they deserve it more. It was definitely unfortunate for FSU but if FSU and Bama played today, who’s picking FSU to win? I think they did the best they could.

Sure, if you accept that the CFP operated in good faith and by the letter of their contract with the conferences. But if anyone on the committee can be found to have been influenced outside those terms, then you might have cause for action. And what’s the odds that someone representing ESPN’s interests didn’t try to lean on these guys. The CFPs contract with the FBS conferences is based around finding the 4 best teams, not revenue maximization. The “eye ball” test argument is undermined by the CFP rules explicitly eliminating margin of victory as a consideration. ESPN purchased this product understanding the terms between the conferences and CFP. If they colluded to tip those scales it could be problematic.

The grant of rights does not lock us into ESPN. It locks us into the ACC. What should be done is any avenue to sue the CFP over the decision should be explored with the intent of conducting discovery. If anything can be produced showing any collusion between ESPN and the CFP then you might have a bunch of avenues for restitution - actual damages against the CFP, possibly break contract with ESPN for bad faith, and possibly dissolving GOR if anyone from ACC was complicit. But these are all remote possibilities but I imagine no one from the CFP committee or ESPN want the email and cell phone records subpoenaed.

If FSU or any other ACC team could find a legit reason to subpoena emails and cell phone records it would be interesting. Could you imagine if an informant had evidence of some sort of collusion? It would be devastating

It wouldn’t take much. I’d love to see what kind fiduciary responsibility exists between the ACC and ESPN in their contract. There has to be some. If so, even the most innocuous effort to sway the pick could violate the contract. There is already significant conflict of interest in having contracts with conferences and the CFP and having their on-air talent openly lobbying one way or another.
