After seeing Clemson’s attack approach in their initial lawsuit complaints, it became clear that they found something that would pierce the GOR.

Then the ESPN/SEC/Texas “obligations” language was revealed which said University of Texas’ GOR rights go back to UT if/when they leave the SEC. It stands to reason similar language is in the ACC/ESPN agreement too.

Then the ACC/ESPN over redaction of that contract was admonished by the NC court and the FL AG issued her legal directive with the power of the state of Florida to provide unredacted contract asap or be sued.

Now this latest amended filing by Clemson regarding ACC damages liability and this Pickens court ruling.

The truth will come out and when it does it will open the floodgates for teams to get the heck out of the ACC.

This doesn’t address the exit fee per se, but if ACC is found liable in harming Clemson’s brand and unduly restraining their negotiations power, there could be a wash on the exit fee costs.

Clarity is coming on all this sooner than folks think. There won’t be a finalized agreement for a while, but it will get to the point that Clemson can give notice they are leaving the ACC b/c their case on the GOR will be all but proven and it is just a matter of settlement amounts. An announcement perhaps as soon as July this year.

Then we turn our attention to where will we land. I think the way Clemson is trying to respect ESPN’s confidentiality and not burn the house down like FSU is doing signals we may be leaning towards the SEC. We shall see.

What you say is good. FSU is going to appeal every ruling which does not go their way in the NC court. The ACC has always gotten favorable treatment from the local and state governments in NC. They are a big business and bring lots of money to the state of NC and NC cities. They are going to get favorable rulings from a UNC law grad, Judge Bledsoe. So, FSU knows this and that is why they dropped the little nugget last week that if the NC Supreme Court ruled against them, they would appeal to the SCOTUS . If they get it in a federal court, they will try to make it a restraint on trade issue which has killed the NCAA IN EVERY SINGLE ONE OF IT'S LAWSUITS. That is the path Clemson is now on by including the new filing for trade restraint and suing for punitive damages. The ACC does not want that going anywhere near a federal court. FSU will follow suit. Both may end up leaving the ACC with ACC having to pay them. The ACC over played it's hand by keeping the ESPN media rights contract locked away with the original copy of the Magna Carta. There is no way a federal court is going to buy that nonsense. And the Florida and SC courts are going to give the ACC a taste of their crooked officiating against Clemson/FSU.

THERE IS STILL THE MATTER OF Jim Phillips allowing ESPN and Stanky and Bubba (SEC & UNC ) keeping FSU out of CFP So the SEC would have a team in the CFP for tv ratings to help ESPN. I THINK FSU WILL GO TO THE BIG. That will be payback to SEC/ESPN. Big will then have a foot in the SEC recruiting area. No way you leave a power 5 conference champion with a 13-0 record out of the playoffs unless someone was paid off. Had it been Clemson, we would still be raising holy heck. And I bet if FSU gets this law suit to discovery in Leon County, FL. how that CFP decision to leave them out went down is going to be put under a microscope. FSU is still plissed about it. ESPN wants no part of that. Directly or indirectly.

The gloves are off. Millions of dollars are on the line. The future of FSU/Clemson FB and its athletic programs are on the line. If the ACC media rights contract show that when a member leaves the ACC, it's media rights leave with it, it is all over for the ACC , and Clemson will get its punitive damages awarded.
